The Supreme Court on Wednesday (12 August) turned down a plea for a common national rehabilitation policy covering people rendered homeless by anti-encroachment demolitions, holding that the subject lies squarely in the policy sphere of states and union territories, Hindustan Times reported. The bench added, "The circumstances may vary from state to state and may, therefore, warrant variations in their respective policy frameworks." Due process was often ignored, he said, and even where notices were issued, no scheme existed to resettle those displaced. If the policy is arbitrary, unreasonable or does not accommodate due process, it will be open to judicial review." They cannot be addressed through a collective policy framed by this court."
