It cannot, through the same negotiation, bring a criminal case to an end. Criminal cases, including cases alleging rioting, were registered in Delhi and several states. The Supreme Court explained this division of responsibility in Abhinandan Jha v Dinesh Mishra in 1967. It applies after a criminal case has reached court. A political assurance may initiate a review, influence the government’s position or lead a prosecutor to consider withdrawal.
