Prosecution as politics

India’s National Fortnightly Magazine
Where the trouble beganThe Associated Journals Ltd (AJL), the company that publishes National Herald, was founded by Jawaharlal Nehru and others in 1937.
The Magistrate, finding prima facie evidence, proceeded with the case and summoned the Gandhis and the other accused in 2014.
Arguing in defence of the Gandhis before the trial court in Delhi, Senior Advocate Abhishek Manu Singhvi termed the entire case “very strange”.
Fifth, and perhaps the most important question of law, is whether the ED even has jurisdiction to investigate the National Herald case.
A January 2015 circular of the ED, under its then Director Rajan Katoch, clarified this position, which made investigating the Herald case impossible.
