Those findings were echoed in a Sept. 3 federal Securities and Exchange Commission complaint and a federal criminal indictment charging Heller with fraud. James Vincequerra, an attorney for Heller creditor Silverview Partners, objected to Heller’s retention of a new financial services firm. “That Mr. Heller doesn’t like the (examiner’s) report doesn’t mean that he gets to shop for an opinion from new professionals. A criminal indictment said Heller defrauded his ATM investors of more than $400 million by operating what amounted to a Ponzi scheme.
