In addition, it should be taken into consideration the flow of information between the parties and the expert appointed by the arbitrators because while party-appointed experts have access to more information, tribunal-appointed experts might encounter difficulties in accessing the information needed and search for help at the arbitral tribunal which might be seen as a disadvantage from the tribunal’s point of view. While tribunal-appointed experts are always regarded as experts according to different international arbitration rules such as the ICC rules, the IBA rules, or Singapore’s Rules of Arbitration, party-appointed experts might be regarded different by the international arbitration rules.
