The court affirmed a district court’s exclusion of “expert testimony” claiming a plaintiff’s exposure to the glyphosate-based herbicide Roundup caused his blood cancer (chronic lymphocytic leukemia).
It’s hardly surprising Monsanto settled and took glyphosate out of its US home lawn and garden Roundup formulation.
His testimony was the only evidence plaintiffs presented.
Plaintiffs must prove the scientific evidence presented is relevant and reliable, the Court said.
But from a jackpot justice plaintiff or lawyer perspective, they are central to nearly every case.
