Gillian Koren, prosecuting, told the court the couple had been in a relationship for four years and had a child. Ms Koren said that the victim was in favour of a non-harassment order and pointed out the offence happened when a court order was in place for him not to approach her. Defence lawyer Ross Dow said Foggin was living in homeless accommodation in Newcastle and was unfit for work. “You have severely impacted on her life and the matter is so serious there is no alternative but to impose a custodial sentence." The sheriff also imposed a non-harassment order preventing Foggin from having any contact with his former partner for the next five years.
