Accordingly, the ITAT held that the assessee had failed to discharge the onus of proving the genuineness of the purchase transaction and confirmed the entire ₹2.79 crore addition under Section 68. The A/R of the assessee company, was time and again, requested to submit the demat account, of the assessee company. It is further concluded that, the A/R of the assessee company, had knowingly tried to guide the stream of investigation in another direction.” Thus, it goes without saying that the share purchase transaction has involved credit of the amount in the books in the name of Spark Commodeal Pvt Ltd. Such credit is directly linked to the share purchase transaction and is also clearly non-genuine as submitted above.
