The U.S. Department of Homeland Security’s (DHS) proposed rule to eliminate the sixty-day grace period for certain nonimmigrants is currently under review by the Office of Management and Budget (OMB). Quick HitsDHS has proposed a rule to eliminate the sixty-day grace period afforded to certain nonimmigrants, such as E, H-1B, H-1B1, L-1, and TN visa holders and their dependents. The sixty-day grace period was implemented in 2016 by regulation. Individuals are eligible for one sixty-day grace period per petition validity period. The sixty-day grace period will remain in effect while the rule continues through the rulemaking process.
