District attorney asks for convicted rapist to be exhumed from Santa Fe National Cemetery

BERNALILLO COUNTY, N.M. — The Bernalillo County District Attorney’s Office is pushing for a convicted rapist to be exhumed from the Santa Fe National Cemetery.
The DA’s Office wants Michael Magirl exhumed to see if his DNA is a match to a July 8, 2002 sexual assault case in northeast Albuquerque.
The case involved a man who broke into a northeast Albuquerque home and raped a woman.
According to the DA’s Office, the CODIS match came back on July 10, 2026, identifying Magirl as a suspect and leading to the petition for exhumation.
He spent 16.5 years in prison after a jury convicted him for multiple residential burglaries and criminal sexual penetration.
