1 to 3 in the present Suit and Defendant No.12 in the said Suit is the Plaintiff No.1 in the present Suit. In view thereof, the Defendants in the present Suit who were the Plaintiffs therein faced with the situation decided to unconditionally withdraw the Suit and the claim against the present Plaintiffs and the Suit property. Mr. Khambata has referred to certain material facts which have a bearing on the maintainability of the present Suit. This is in view of the variance of the claims made in the present Suit as that in the 2011 Suit. Further, in that Suit no claim for adverse possession is made which has been claimed in the present Suit.
