According to the DOJ, there are two main pieces of ‘evidence’ of Duke Law having violated Title VI. According to the DOJ, Duke Law admissions categorized each response to the essay prompt asking how applicants would further Duke Law's mission with a label, one of which was “diversity/services.” Personal statements, letters of recommendation and GPA are all factors that are considered by Duke Law. The DOJ’s alleged proof against Duke Law would easily fall in a court of law, which means they are counting on Duke not to push back. The current black population in the U.S. stands at 14%, which means black students are significantly underrepresented in Duke Law.
