In processes filed before the court, the State argues that Mr Boasiako’s intended appeal has no reasonable prospect of success and therefore does not justify his release from custody. The Attorney-General further contends that Mr Boasiako has not demonstrated any special circumstances that would warrant bail pending the determination of his appeal. The State maintains that the grounds being relied upon by Mr Boasiako do not establish a sufficient basis for his release while the appeal is pending. The court also ordered the confiscation of mining equipment, firearms and cash seized during investigations into the illegal mining activities. The court will consider the State’s objection as it determines whether Mr Boasiako should remain in custody pending the determination of his appeal.
