Court rules casino operator not liable for VIP deposits not used for gamblingThe top court has ruled that a casino concessionaire is not jointly liable for funds deposited with a gaming promoter when the money was not intended for gambling. The Court of Final Appeal (TUI) dismissed an appeal by a man who sought to recover HKD43.82 million, including interest, from a casino concessionaire. The court found that the deposits were made solely to earn interest and receive the promised services, rather than for gambling. He later asked the casino concessionaire to return HKD37.2 million but received no response. In this case, the court found that the deposits were intended to generate interest rather than facilitate gambling.
