The Harrison County Prosecuting Attorney’s Office charged Oliver with the class A felony of first-degree assault and the felony of armed criminal action. The armed criminal action charge alleges a dangerous instrument was knowingly used in the commission of the assault. The affidavit alleges Oliver initiated a physical altercation shortly after arriving and struck the individual in the head with a shovel. During the officer’s initial contact with Oliver, Oliver allegedly indicated that he had blacked out, had badly beaten the individual, and probably needed to go to jail because of his actions. A witness at the scene corroborated Oliver’s account, according to the affidavit, and reported that Oliver struck the individual with the shovel before leaving the residence.
