The change impacts affirmative asylum seekers, who have applied for asylum with USCIS, compared to defensive asylum seekers who are already facing removal proceedings in court. Lawsuits are likely to follow, but thousands of asylum seekers will be impacted in the meantime, legal experts say. This year, Fort Snelling Immigration Court has adjudicated 2,100 asylum cases, up from a total of 1,700 last year.
