Azad Majid launched the challenge after Southampton City Council turned down his retrospective application for serviced accommodation at 124 Bevois Valley Road.
During a visit to the property, he saw the flats in the building were being used for short-term serviced accommodation.
They also argued the flats were below minimum space standards, which made them more appropriate for serviced units.
Mr Andrews said the unauthorised use of the property played a role in providing serviced accommodation for visitors and workers, including at two nearby hospitals.
A Southampton City Council spokesman said an enforcement notice to cease the serviced accommodation use was served on January 15.
