Lawlink: My neighbour’s new fence is on my property – what do I do?
["Alex O'Neill"]
Limerick Post Newspaper
My neighbour recently erected a new fence which I believe extends around one meter into my property.
Firstly, you should try and confirm, as accurately as possible, where the legal boundary lies by reference to your respective title deeds.
Registry of Deeds maps can be less precise however and frequently can disclose an overlap in boundaries.
As the fence appeared to have been a party boundary, consent should have been sought to moving or erecting any fence.
You should avoid taking matters into your own hands by removing or amending the fence yourself or entering onto the property.
