The High Court suspended the implementation of its declaration, meaning there is no immediate transfer of power or requirement for the country to hold an election within days.
Deputy President Kithure Kindiki does not automatically take over simply because the court has ruled on the timing of the General Election.
Article 134 sets out restrictions on the exercise of presidential powers from the date of the first vote in a presidential election until the newly elected President assumes office.
In simple terms, Article 134 does not mean that the President automatically loses his powers when a court says an election was due.
The restrictions only apply once the presidential election process has reached the point set out in the Constitution.
