Most dictionaries do not even list the meaning — ‘to kill’ — that the government now proposes when combined with ‘47’ — slang for President Trump, the forty-seventh President — ‘86’ becomes nothing more than a call to oppose President Trump.
Worse still, the affidavits also misled the magistrates with material falsehoods, bizarrely insinuating that Mr. Comey’s lawyer (a former U.S. Attorney) and Mr. Comey’s wife had obstructed the government’s investigation.
Their views are entirely consistent with the government’s inability to find any evidence that Mr. Comey would have understood ‘86’ to mean ‘kill’ in the organized crime context despite trying numerous times.
Those violations warrant dismissal regardless of any grand jury misconduct, but they also support a reasonable inference of irregularities before the grand jury.
And, taken together, Mr. Comey has demonstrated substantial particularized need for disclosure of grand jury materials that greatly outweighs traditional reasons for grand jury secrecy.
