The study claims judges ordered people to be detained ahead of trial in about three-quarters of the instances that Cook County prosecutors requested it.
The INPJ says its data is based on observations of 167 unique pretrial detention hearings.
The study only covers cases where prosecutors sought pretrial detention and doesn’t account for the frequency of pretrial detention petitions.
During May and June 2025, Cook County prosecutors sought pretrial detention in about 15 percent of all cases, according to the Cook County State’s Attorney’s office data.
In more than two-thirds of the observed pretrial detention hearings, the primary charge against the accused involved the alleged illegal possession—but not use of—firearms.
