HUD's regulations at 24 CFR part 1 (HUD's Title VI regulations) implement nondiscrimination requirements under Title VI of the Civil Rights Act of 1964. HUD's Title VI regulations were last substantively amended in 1973, consistent with uniform amendments adopted by Federal agencies at that time. There are also serious concerns about whether HUD's Title VI regulations pass constitutional muster under the Equal Protection Clause. HUD's Title VI regulations resulted from uniform amendments adopted by Federal agencies and use the same or similar language as DOJ's former Title VI regulations. It should also produce a qualitative benefit by aligning HUD's Title VI regulations with the best reading of Title VI and DOJ's revised Title VI regulations.
