In an opinion issued July 31, a six-justice majority reversed a Michigan Court of Appeals judgment, vacated the Michigan Public Service Commission's December 2023 approval and remanded the case for further proceedings. The court said that approach was inconsistent and did not allow regulators to make a “reasoned choice” among project alternatives. The proposed Great Lakes Tunnel would replace the existing dual Line 5 pipelines that cross the Straits of Mackinac with a single pipeline running inside a tunnel beneath the lakebed.
