Confidentiality agreements—also known as non-disclosure agreements (NDAs) or gag orders—almost always involve a power imbalance, and they’re becoming more prevalent in the art world. As the art world moves toward a business model mimicking corporate America, staff are seen as disposable. The art world has always been built on discretion, for better or worse. Like Huffman, Bentley sees the prevalence of gag orders as connected to a rise of the “corporate entity” in the art world. Despite the fact that Bentley has signed NDAs, he thinks, on the whole, they’ve gotten out of hand in the art world.
