New Jersey’s top court won’t force Zurich to redo motorist coverNew Jersey’s Supreme Court on Thursday batted down a motorist’s attempt to force a Zurich unit to boost his employer’s uninsured motorist coverage from $15,000 to $2 million. The case, Craig Chiaccheri v. Zurich American Insurance Company, came to the New Jersey Supreme Court on two questions certified by the U.S. Court of Appeals for the Third Circuit. Because the at-fault driver’s $100,000 policy exceeded that uninsured motorist limit, Zurich denied Mr. Chiaccheri’s uninsured motorist claim. He sued, arguing state law entitled him to uninsured motorist coverage matching the policy’s full liability limit. Judge Patterson noted lawmakers passed the provision to override a 2005 state Supreme Court ruling that had allowed insurers to reduce uninsured motorist coverage for employees to the level of their personal policies.
