The Gauhati High Court (Aizawl Bench) on July 29 upheld the conviction and sentence of a 33-year-old man for raping his own mother and affirmed the 15-year Rigorous Imprisonment awarded to him by the trial court. Before the High Court, the appellant argued that there were discrepancies between the prosecutrix's statement recorded under Section 164 CrPC and her deposition before the Trial Court. Rejecting the submissions, the Bench held that it was unable to find any discrepancy between the prosecutrix's testimony and her statement under Section 164 CrPC. The Bench held that this explanation did not cast any doubt on the authenticity of the prosecutrix's testimony. Finding no ground to interfere with the impugned judgment, the High Court dismissed the appeal and affirmed the appellant's conviction and sentence.
