Former Greek restaurant operators penalised for breach affecting migrant worker

The Federal Circuit and Family Court imposed a penalty of $28,170 against Big Fat Greek (Belmore) Pty Ltd which operated the Sydney business.
The company, which did not comply with the compliance notice, was also ordered to pay $11,874 that was owed to the worker, plus interest and superannuation.
An inspector formed the belief that the worker’s casual minimum wages, overtime entitlements, penalty rates, and clothing allowance had been underpaid.
Judge Nicholas Manousaridis found that the company’s failure to comply with the compliance notice was “deliberate and contumacious”.
“Deliberate breaches of workplace laws – including breaching a compliance notice – are unacceptable.”
