The Supreme Court of Delaware has refused an interlocutory appeal from Fox News Network, LLC, allowing California Governor Gavin Newsom’s defamation lawsuit against the network to proceed in the state’s Superior Court. The August 6, 2026 order, signed by Justice Abigail M. LeGrow, leaves intact an April 30, 2026 decision by the Superior Court that denied Fox News’ motion to dismiss Newsom’s suit. On June 6, 2025, Newsom spoke on the telephone with President Donald Trump for about sixteen minutes, a conversation Newsom subsequently discussed publicly. Newsom filed his complaint in the Superior Court of Delaware on June 27, 2025, alleging defamation per se and violations of California’s Unfair Competition Law.
