On Tuesday, a federal judge ruled that Utah is allowed to enforce its anti-gambling laws against Kalshi, declining the financial exchange’s claim that federal oversight covers its sports prediction contracts from state interference.
U.S. District Judge Robert J. Shelby ruled that state authorities can ban prediction market contracts linked with sports, rejecting the lawsuit Kalshi opened in February.
and Judge Shelby added that Congress did not change that position even when commodities legislation was written during the 2008 financial crisis.
Utah Attorney General Derek Brown said that people can’t just rebrand illegal gambling as a federal commodity and was happy that the federal judge agreed with this.
Brown supported that decision, reminding that Utah’s constitution bans gambling to protect families, emphasizing that offering online gambling to local players is still a third-degree felony under Utah laws.
