Court Blow for Senator Hezena Lemaletian as Auctioneers Move to Seize Property
['Richard Kamau']
Nairobi Wire
Nominated Senator Hezena Lemaletian faces the potential auction of her household goods after auctioneers stepped in to enforce a court decree stemming from a unpaid landscaping contract.
Viewline Auctioneers served the senator with a formal proclamation after securing warrants to execute a court judgment.
The action aims to recover Ksh 447,823.77 awarded to contractor Silas Thuranira Muturia, trading as Simut Logistics, following the dismissal of Lemaletian’s High Court appeal.
The Small Claims Court ruled in favor of the contractor, observing that the senator failed to file a formal counterclaim or plead a legal set-off against the invoiced balance.
The contractor has also separately applied to recover an additional Ksh 224,000 in party-and-party legal costs incurred during the High Court appeal proceedings.
