Judge throws out DOE’s blanket ‘still interested’ FOIA policy

The Energy Department tried to use a mass "still interested" notice to close older FOIA requests.
In a statement, American Oversight Executive Director Chioma Chukwu said Jackson’s ruling is “a victory for transparency, accountability, and the public’s right to know.”
In its August 2025 notice, Energy wrote that the policy was needed to help clear its backlog and process newer FOIA requests.
The agency wrote that its incoming FOIA requests had tripled over the previous four years.
“Together, these measures shift the costs and burdens of government transparency from agencies to the people seeking to hold them accountable,” American Oversight wrote.
