In July 2019, performer Jailen White was struck in the back by a bullet during an altercation and left paralyzed at Club Rehab, a nightclub in Spartanburg, South Carolina. Mr. White, as assignee of Rehab and Mr. Webber’s rights under the policy, countered with a breach-of-contract claim. Nor did it matter that Mr. White was only a bystander, Judge Austin wrote. Rehab Experience and Mr. Webber, who never responded to Covington’s suit, had a clerk’s entry of default filed against them in January 2024.
