The High Court sentenced Mpofu to an effective 15 years’ imprisonment and Chimombe to an effective 12 years after suspending portions of their sentences subject to conditions, including restitution.
Regarding Mpofu, the court found that three of his proposed appeal grounds, grounds two, three and four, raise questions of law.
Consequently, he is entitled to pursue those issues before the Supreme Court without first obtaining leave.
The ruling means neither Mpofu nor Chimombe can ask the Supreme Court to revisit the High Court’s findings on the evidence or reconsider the prison terms imposed.
Instead, their legal teams will now proceed to file substantive appeals confined strictly to the legal questions identified by the Supreme Court.
