The Court of Appeal held that the High Court was right to rule the prosecution failed to prove the rape charge beyond a reasonable doubt.
PUTRAJAYA : The Court of Appeal has unanimously upheld the acquittal of a former car jockey over an alleged rape outside a club in Kuala Lumpur, three years ago.
Noorin held that the High Court was right to rule the prosecution failed to prove Satia’s charge under Section 376(1) of the Penal Code beyond a reasonable doubt.
She added that Satia’s DNA was not found on the victim or even the car where the alleged rape took place.
However, the High Court, upon Satia’s appeal, quashed his conviction and acquitted him last year.
