The NSW government will not broaden its hate speech laws, despite a review it commissioned finding vulnerable groups should be protected equally under criminal law.
Attorney-General Michael Daley said broadening the law raises questions about free expression, religion and consistency in criminal law.
The review concluded that limiting the newer criminal offence to race alone had fuelled concern that the law treated some forms of hatred more seriously than others.
The review was commissioned after the Minns government introduced a criminal offence for racial vilification following antisemitic incidents.
"The Government's view is that expanding the racial hatred offence to cover other attributes raises complex questions about freedom of expression, freedom of religion, and the consistent application of the criminal law across the community."
