SIOUX CITY, Iowa — A Sioux Falls man charged in connection with the death of his 14-year-old niece has waived his right to a detention hearing, opting to remain in federal custody. Defense attorney Peder Bartling told Roberts during an initial appearance that he would confer with Milk ahead of a July 30 detention hearing, where Milk would be given the opportunity to contest his detention by the U.S. The filing also asked Roberts to cancel the detention hearing. Prosecutor Forde Fairchild had requested the detention hearing, indicating that Milk’s criminal charges in South Dakota didn’t require him to remain behind bars. He said the federal detention is the only thing keeping Milk in custody.
