Armstrong will declare a state public health emergency, prohibiting the sale, possession, and use of all kratom products across North Dakota. To cement the ban into state law and give local law enforcement the statutory authority to prosecute violations, Gov. Armstrong is convening a special session of the North Dakota Legislative Assembly starting September 2. Furthermore, calls to the poison control center involving kratom have surged from just five in 2023 to 22 in 2025. A legislative working group led by Sen. Michelle Axtman and Rep. Pat Heinert has been formed to draft the permanent statutory ban ahead of the three-day special session.
