While federal right-to-try laws and most state equivalents limit access to people who are terminally ill, Montana’s version is open to anyone who gives informed consent and can pay.
If approved, the company can set whatever price it wants for the drug and sell it through experimental treatment clinics in the state.
Under FDA expanded access, companies can only charge for the costs of making, transporting, and monitoring the drug.
Anzinger founded the Montana Experimental Treatment Review Board, the state’s first private review panel.
He plans to sell the drug at cost and hopes the Montana data will help accelerate FDA approval.
