Since 2023, approximately 18 states have passed laws restricting diversity, equity, and inclusion (DEI) initiatives in higher education (Hoyos Ensuncho, 2025). The court found that certain sections of Florida’s “Stop WOKE Act” were unconstitutional, particularly as they applied to higher education. A systematic review found that cultural-competence training can improve mental health professionals’ attitudes, knowledge, and skills (Chu et al., 2022). Reasons for Continued CautionWhile the Pernell v. Lamb decision is significant, it does not resolve all concerns about DEI and higher education. Mental health education sometimes requires students to examine challenging questions about bias, inequality, identity, trauma, and professional power.
