“The death penalty is inconsistent with the constitutional right to life and with Ghana’s international human rights obligations,” he stated.
Dr Ayine said offences that currently attract the death penalty would instead carry life imprisonment under the proposed reforms.
Ghana removed the death penalty from ordinary criminal offences and offences under military law through the Criminal Offences (Amendment) Act, 2023 (Act 1098) and the Armed Forces (Amendment) Act, 2023 (Act 1099).
However, constitutional provisions referencing the death penalty remain, requiring constitutional amendment before the change can be fully reflected in the supreme law.
The proposed Human Rights Act is intended to consolidate additional rights protections and provide a legislative framework for their enforcement.
