Petition Filed to Remove CS Duale from Govt

A petition has been filed at the High Court seeking the removal of the Health Cabinet Secretary, Aden Duale, over alleged ethnic incitement and violation of leadership standards.
According to the court papers, the petitioners said the Constitution requires State officers to exercise restraint in public communication to prevent politically instigated ethnic violence.
"The constitutional questions raised in this Petition must be understood within the historical context of Kenya's experience with politically instigated ethnic tensions and violence," the petitioners argued.
They cited Article 33(2) of the Constitution, noting that constitutional protection does not extend to incitement to violence or advocacy of hatred that constitutes ethnic incitement.
They thus urged the court to find that Duale used ethnic slurs, dehumanising metaphors and language amounting to ethnic vilification, and that he acted against constitutional requirements for leadership and integrity.
