James Lyle Diven of Hamilton returns to Caldwell County Circuit Court today for another probation violation hearing after a series of court appearances that began with a misdemeanor trespassing charge earlier this year and continued through multiple probation proceedings. Appearing through Webex from custody and represented by attorney Amy Schley, Diven admitted the first alleged probation violation. Following the filing, Judge Kanoy issued a probation violation arrest warrant alleging Diven violated the alcohol condition of his probation. Court records also show Diven previously faced a separate probation violation warrant alleging he violated Condition No. During the probation violation hearing, the court is expected to determine whether the latest allegation has been proven and whether Diven will remain on probation or face revocation and sentencing.
