Beyond the jurisdictional dispute, the draft agreements would also transition several detention facilities to ICE's updated National Detention Standards, introduced in June.
The proposed contracts arrive amid broader tensions between federal immigration authorities and states seeking greater authority to monitor detention conditions.
At the time, DHS spokesperson Lauren Bis argued that what she described as "sanctuary politicians" had made privately operated immigration detention facilities increasingly difficult to sustain financially.
