UN experts say victims of Trafigura’s toxic waste disposal await justice after 20 years

United Nations experts on Tuesday warned that 20 years after the Probo Koala toxic waste disaster in Côte d’Ivoire, thousands of victims still remain without justice, compensation, or effective remedies, highlighting what they call “environmental racism” and corporate impunity.
In August 2006, the MV Probo Koala, chartered by commodity trading company Trafigura, offloaded toxic waste at the Port of Abidjan, Côte d’Ivoire.
Six years after the Dutch ruling, civil society organizations brought a case against Côte d’Ivoire before the African Court on Human and Peoples’ Rights.
A 2023 judgment relied on the Bamako Convention to prohibit hazardous waste imports into Africa, recognizing that such wrongs constitute gross human rights violations.
Additionally, the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes also prohibits the export of toxic waste to countries lacking capacity for safe disposal.
