The Federal Court ordered the Langkawi Municipal Council to pay holidaymaker Yong Shui Tian RM50,000 in costs.
PUTRAJAYA : A landmark ruling holding the Langkawi Municipal Council liable for negligence over its failure to maintain coconut trees at Pantai Cenang will stand after the Federal Court today dismissed the council’s application for leave to appeal.
Leave to appeal to the Federal Court is granted only where a case raises novel constitutional or legal issues of sufficient public importance.
Delivering the judgment, Justice Faizah Jamaludin said the High Court had erred in dismissing Yong’s claim.
It remitted the case to the High Court for an assessment of damages.
