The Supreme Court has agreed to hear on Tuesday August 4, 2026 a Public Interest Litigation (PIL) challenging the appointment and continuance of Bihar Panchayati Raj Minister Deepak Prakash, who is alleged to be holding ministerial office despite not being an elected member of the State Legislature.
A mentioning was made before the CJI Surya Kant's led bench where the counsel submitted, "Your Lordships are examining the constitutional validity concerning the Bihar Minister.
Seven months, 22 days have passed and he is still continuing as the Minister..no counter also filed""That is on file or not filed, we will hear.
How are you retaining a minister beyond six months when he is not elected?," the CJI said while agreeing to list the case.
According to the plea, such reappointments amount to a circumvention of constitutional safeguards and undermine representative democracy.
