Bush appointeeFederal judges rarely grant interviews, and none of the judges who criticized the Justice Department in their orders granted interviews to ProPublica. “I would call it a transformation of the role of the Justice Department,” he said. The result, Bernard said, is that “the government will lose more cases as a result of the way the Justice Department is behaving.”
