The petitioner contended that the proceedings were initiated solely on account of default in repayment of his personal credit card dues and had no connection with the discharge of his official duties.
Counsel for the petitioner submitted that the credit card was issued as a commercial banking product and that the Bank had the authority to recover the dues from his salary.
The Court observed that while the Bank was entitled to recover the outstanding amount in accordance with the contractual terms, mere default in repayment of personal credit card dues did not amount to misconduct under the service regulations.
