TBF launched the application against the Departments of Social Development (DSD), Justice and Constitutional Development, Basic Education (DBE), all provincial education departments (PEDs), and the South African Police Service, arguing that failures to maintain and use the register have left millions of children vulnerable. Court ProceedingsDuring the court proceedings, the Department of Social Development, which administers the register, opposed the application. Pillay said despite the DSD's opposition, TBF and SECTION27 reached a settlement with the Department of Basic Education and provincial education departments. The education departments have also undertaken to ensure that no individual listed in Part B of the register is employed or retained in a position involving contact with children. Pillay said while the settlement agreement has now been made an order of court, judgment has been reserved in the remaining proceedings against the Department of Social Development.
