The Home Office must specify the reason it believes an employer has contravened right to work laws when it issues a fine, the UK Supreme Court has ruled.
The case, which went all the way to the Supreme Court, followed an inspection of a Middlesbrough curry house.
The penalty notice stated: “We have encountered a suspected breach of section 15 by your business on 15 January 2023.
But on Monday, UK Supreme Court justices unanimously allowed it.
Right-to-work fines tripled in January 2024 to £45,000 for a first breach of right-to-work rules and £60,000 for repeated violations.
